1. Introduction
Welcome to the “Eyes on the Road” campaign. This initiative is a collaborative effort between the Hawaii Department of Transportation (HDOT) and the University of Hawaii (UH). By participating in this campaign, you agree to these Terms and Conditions.
2. Eligibility
To be eligible for the free dash cam, participants must:
- Be residents of Hawaii. Proof of residency is required to pick up the camera.
- Possess a valid driver’s license or proof of residency.
- Note that the program operates on a first-come, first-served basis.
3. Dash Cam Usage
The dash cam provided is for personal use and must be installed and used in accordance with the provided instructions. By participating in this campaign, you agree to the following:
- The dash cam will be used primarily for recording roadway conditions and assets.
- You will not intentionally tamper with or alter the dash cam’s settings to prevent it from functioning as intended.
- The resale of the provided dash cam is strictly prohibited.
- If the dash cam is lost or stolen, you must report it to the program immediately.
- Providing any video or recording to law enforcement, insurance providers, or others is the sole responsibility of the end user.
4. Data Collection and Usage
- The dash cam will collect video footage of roadways and assets.
- Collected footage will be anonymized; license plates and faces will be blurred to ensure privacy.
- The anonymized data will be used by HDOT for analyzing roadway conditions and infrastructure assets.
5. Privacy and Data Protection
- All data provided to State agencies will be anonymized to protect participants’ privacy.
- Data will be stored securely and used solely for the purposes outlined in this campaign.
6. Ownership and Intellectual Property
- The dash cam remains the property of the campaign for the duration of the study.
- The end user provides an irrevocable, perpetual world-wide license of the data to HDOT’s providers.
7. Liability and Indemnification
- HDOT and UH are not liable for any damages or injuries resulting from the use of the dash cam.
- Participants agree to use the dash cam in a manner that complies with all applicable laws and regulations.
- By participating, you agree to indemnify and hold harmless the State of Hawaii, the University of Hawaii, and any of its contractors or providers from any claims, damages, losses, liabilities, and expenses arising out of your participation in this program or use of the dash cam.
- The dash cam works with a mobile app that may utilize your mobile data plan. By participating, you agree to the use of your mobile data plan and indemnify the program against any data usage charges incurred.
8. Termination
- HDOT and UH reserve the right to terminate the participation of any individual who does not comply with these terms.
- Participants may opt out of the campaign at any time by returning the dash cam.
9. Amendments
- HDOT and UH reserve the right to amend these Terms and Conditions at any time. Participants will be notified of any changes.
